1. Acceptance of Terms
These Access Special Offer Terms of Use explain the relationship between you, who agree to the Terms of Use and Gulet Group regarding your use of the Access Special Offer. Gulet Group reserves the right to amend or change these Terms of Use at any time.

2. Registration
In consideration of your use of the offers provided by Access Special Offer, you agree to be solely responsible for: a) providing true, accurate, current, and complete information about you as prompted by Access Special Offer registration form (the "Registration Information"), and b) maintaining and promptly updating the Registration Information to keep it true, accurate, current and complete.
If you provide any information that is false, inaccurate, out of date, or incomplete, or Gulet Group has reasonable grounds to suspect that such information is false, inaccurate, not current or incomplete, Gulet Group may suspend or terminate your use of Access Special Offer. Gulet Group agrees to make reasonable efforts to implement accurately your requested changes, additions, or deletions to Registration Information within 7 business days of receipt of such written information but can not accept any liability if it fails to do so.

3. Confidentiality of Gulet Group information
In order to gain access to Access Special Offer, you agree to these confidentiality provisions:

3.1. You acknowledge that you may obtain direct access via Access Special Offer to certain Gulet Group confidential information, including Gulet Group databases containing confidential information of Gulet Group, such as technical, contractual, pricing, marketing, and other valuable information ("Information"). You must hold Information in strict confidence and may provide Information to associates only on a need-to-know basis. You may not disclose any Information to any yacht broker, Travel agent, adversary without the written permission of Gulet Group. Title to Information remains with Gulet Group. You agree, either as an individual or on behalf of your employer, to be bound by the provisions of the Section 3. Furthermore, if you are acting on behalf of your employer, your employer agrees to indemnify you for violations of the Section 3

3.2 You do not acquire any rights in Information, except the limited rights to use Information as described above.

3.3 Your obligations regarding Information expire 2 years after the date of disclosure. Upon termination of the Terms of Use or Gulet Group's written request, You must cease use of Information and return and destroy all Information.

4. Content
You agree not to use the Services for any unlawful activities including (without limitation) attempting to compromise the security of any networked account or site, operating an illegal lottery or gambling operation, stalking or making direct threats of physical harm.
Additionally, You agree not to use the Services to:

a) impersonate any person or entity, including, but not limited to, a Gulet Group official, or falsely state or otherwise misrepresent your affiliation with Gulet Group or any other person or entity;

b) transmit any Content that you do not have a right to transmit to the public under any law or under contractual or fiduciary relationships (such as inside information , proprietary or confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

c) transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

d) intentionally or unintentionally violate any applicable local, state, national or international law, or any regulations having the force of law;

e) collect or store personal data about other users;

f) place orders or request changes to contracts between you or your employer and Gulet Group unless authorised by your employer to do so;

g) transmit, or allow others to transmit spam, newsgroup postings or other unsolicited emails, or to otherwise abuse your access to the Services and or the Portal.

5. Spam email and postings and other abuses of the Portal
You agree that Gulet Group would be irreparably harmed by the use, by you or others, of Gulet Group 's Services or facilities in connection with the transmission of spam newsgroup postings or unsolicited email or any other use of the Portal, your password or the services that is in violation of these Terms of Use, and that Gulet Group is entitled to obtain injunctive relief against any such transmission (in addition to all other remedies available at law or in equity). Gulet Group reserves the right to block, filter or delete unsolicited email.

6. Indemnity
You agree to indemnify and hold Gulet Group, and its subsidiaries, affiliates, officers, agents, co-branders, alliance members, or other partners, and employees, harmless from any claim or demand, including reasonable attorney's fees, made by any party due to or arising our of your use of the Services, including any use by your employees (including as described in Section 3.1), your connection to the Services, your violation of the Terms of Use, or your violation of any rights of another.

7. Notices, modification and termination of Services
Gulet Group may send notices to you via email or regular mail. The Services may also provide notices of changes to the Terms of Use or other matters by displaying notices or links to notices to you generally on the Services. Gulet Group reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. Gulet Group in its sole discretion, may terminate your password, your account, use of the Services for any reason, including, without limitation, for lack of use or if Gulet Group believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Use. Any termination of your access to the Services under any provision of the Terms of Use may be effected without prior notice, and Gulet Group may immediately de-activate or bar any further access to the Services. Further, Gulet Group will not be liable to you or any third-party for any termination, modification, or suspension of the Services.

Because Gulet Group has no control over such sites and resources, You acknowledge and agree that Gulet Group is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. Gulet Group will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
